Terry Murray discusses role as Flyers? minor league coach

Terry Murray has been a fixture of the Philadelphia Flyers organization. Now he?ll help mold players preparing to join the big team.

He discussed his role as the head coach of the team?s AHL affiliate ? the Adirondack Phantoms ? with CSNPhilly.com. (Murray accepted the job in June.)

Tim Panaccio points out all the times Murray has worked for the Flyers:

Three times, Terry Murray played for the Flyers. Then he coached them to the 1997 Stanley Cup Final. He later scouted for them.
?
More recently, he was an assistant coach under Ken Hitchcock, and then John Stevens.

(One might also joke that he coached ?Flyers West? ? aka the Los Angeles Kings ? before being fired last season.)

Murray said it won?t take him much for him to get re-acclimated with the organization itself, although he?ll need some time to put ?faces to the names.?

With the lockout in full swing, Murray said he?ll turn to guys like Brayden Schenn and Sean Courturier to help lead the team.

?The drills will be the ones I used over the years,? Murray said. ?Brayden will remember and be familiar with them. These are smart hockey players.?

? ? And they do it right the first time. Yeah, I will look to him and to [Sean] Couturier and players who are the smart and good players to set the example every day.?

At least until ? or if ? the NHL games start again, that is.

"Hey, I didn't put that there" - HypnoThoughts.com

I am at about Week 6 of my hypnotherapy course. I've put a couple of fellow students into trance (and returned the favor) and learned a little bit here and there about what hypnosis can be used for, NLP (very cursory intro), etc.

I've found out more about various types of inductions here on Hypnothoughts than I have in the course. I guess that's to be expected: you don't want to overwhelm the students. I can't wait to try some of them out, though.

One of the things I have really enjoyed about previous hypnotic experiences is the stuff that I didn't put into the picture. For example, when I picture a relaxing place, I'm well aware that I am putting the grass THERE and I've put some trees over THERE and it's up to me how blue the sky is. When something shows up in my visualization that I didn't intentionally put there, I get a little "hit" that makes me really want to do hypnosis again. That is the feeling I really enjoy about trance. For example, during one session my fellow student told me to walk to a glade in the forest (okay) and sit by the bank of a river (okay)...when suddenly a small, brightly-colored paper sailboat floated down the stream (whoa!).?

I can't seem to make this experience happen. When I've listened to sessions that purport to introduce me to my inner self, I either go into somnabulism (and remember nothing) or absolutely nothing happens with the visualization. I follow all of the steps, and I never get any of the things happening that the guiding voice tells me is supposed to happen.?

Likewise, I have not yet had anything remotely like the little sailboat happen when I do self-hypnosis. (I'm practicing self-hypnosis about 5 times a day -- it's frustrating because I know what being in trance feels like, I really like the feeling, and yet I can't induce it on command. Each self-hypnosis session for myself takes at least 10 minutes, and I have to tell myself to relax, to walk down steps, to really visualize my special place, etc.)?

Is there a term for "the thing I didn't put there" in hypnosis? Hallucination doesn't seem correct.?

Is there anything I should be doing to improve my experience of self-hypnosis? I know that John Cleesattel (and others) say that this experience is one you're supposed to allow and can't make happen, but certainly I'm showing up expecting to go into trance and it seems to be a tough sell regardless.?

T-Mobile leases 7,200 mobile towers to Crown Castle in a 28-year, $2.4 billion deal

TMobile leases 7,200 mobile towers to Crown Castle for $24 billion for 28 years

T-Mobile's just received a hefty cash boost thanks to a tower-leasing agreement it's entered into with Crown Castle. The deal leases 7,200 wireless towers to the infrastructure firm for a term of 28 years in exchange for $2.4 billion -- that T-Mobile's parent Deutsche Telekom will use to pay off debt. As part of the contract, Crown Castle can buy the towers outright when the deal ends in 2040 for a further $2.4 billion -- and is planning to make money by adding another tenant to T-Mobile's system, so depending on your carrier, you might find your coverage suddenly getting a lot better.

Italian unions strike against PM Monti's spending cuts

ROME (Reuters) - Two of Italy's biggest unions marched through Rome on Friday to protest against Prime Minister Mario Monti's cuts in public spending as opposition grows to austerity policies aimed at steering the country out of its economic crisis.

The strike followed clashes between anti-austerity protesters and police in Madrid and Athens this week and coincided with labor unrest at the ILVA steel plant in southern Italy.

"We are here to protest against Monti's politics, because up until now he has just made the weakest pay," said Pio Zappaterreno as he rallied with fellow members of CGIL, Italy's largest union, in the city center.

Monti's coalition passed spending cuts in August that included a modest downsizing of the public sector, where wages have already been frozen for more than two years, and cuts to state healthcare funding.

University professors, public administration employees and health workers in the CGIL and UIL unions were to stop work in support of the march to the Colosseum. Garbage collectors were also joining the work stoppage.

"At the moment I just can't see a future that gives us any hope, particularly for the youth," former soldier Emilio Amiraglia said at the march.

The spending cuts followed unpopular austerity reforms and an overhaul of hiring-and-firing rules that drew stiff opposition and protests from labor unions earlier this year.

"Starve the beast, weaken it, make it inefficient, undermine its potential, interrupt its mission - these are the principles that are behind the government's public administration policy," CGIL's leaders wrote in a letter explaining the walkout.

To head off a Greek-style debt disaster, Monti raised taxes and cut pensions when he took over from Silvio Berlusconi in November, subjecting Italians to an "unprecedented amount of sacrifices," he said in an interview on CNN this week.

Austerity measures have hurt household spending and deepened Italy's recession. Italian unemployment rose to 10.7 percent in July, the highest since 2004.

Since August, anger over austerity and job losses has led to a growing number of industrial disputes, including at the ILVA steel mill in Taranto and at an aluminium smelter in Sardinia.

Although Monti is the most popular political figure in Italy, his comments on Thursday that he would be willing to serve again if no clear leader emerged from elections next spring prompted a chorus of complaints from opposition parties.

Chambers Street Properties $700 Million Credit Facility Will Help with

Chambers Street Properties (formerly CB Richard Ellis Realty Trust), based in Princeton, New Jersey, has secured a $700 million revolving credit facility through a consortium of lenders led by Wells Fargo Securities, LLC and RBC Capital Markets. This capital infusion will help the REIT go on a shopping expedition, mostly for industrial properties, although it also buys office buildings.
?
The new facility will make available a line of credit over the next four years with an option to extend it for an additional year. Chambers Street also has the option to request an increase in the facility of up to $700 million for a total of $1.4 billion.
?
"This new line of credit reinforces the strength of our investment strategy and provides us with an expanded capital platform to build upon our existing portfolio and support the next phase of the company's growth as an investor in high-quality, net-leased commercial real estate," said Jack A.Cuneo, president and CEO of Chambers Street Properties.
?
Chambers owns commercial properties across three continents in more than 40 markets: It has 124 properties around the globe. Of those, 112 properties are in the US, seven are in the United Kingdom and five are located in Germany. In addition, Chambers Street owns an interest, with institutional partners in Asia, in eight properties in China and Japan.
?
Philip-Kianka.jpg

Philip Kianka

Last month, Chambers Street announced the purchase of a fully-occupied 1.1-million-square-foot- warehouse/distribution center in Kansas City, Kansas, as well as the purchase of a 1-million-square-foot state-of-the-art logistics facility near Koblenz, Germany. The latter is still under construction, but is 100% pre-leased, says Philip Kianka, executive vice president and chief operating officer at Chambers Street Properties. The facility in Koblenz is expected to open possibly by December 2012, although the opening date may be pushed back, he says.???
?
"We have focused on warehouses and logistics (properties) since the beginning," of the company, says Kianka. CB Richard Ellis Realty Trust started with a private placement in 2004 but there was an IPO in November 2006, he says. "We became Chambers Street Properties on July 1, 2012," says Kianka.
?
"Before the name change, we were part of CBRE Advisors and employees of CBRE Global Investors with an annual contract that came up every April," says Kianka. "But as we matured as a REIT, and after we raised equity through the public markets, we decided to take over the management team and become direct employees of the REIT," he says.?
?
Chambers Street's acquisitions are guided by a change in logistics patterns, says Kianka, "Everyone (who owns industrial properties today) is reviewing their needs and relocating near ports or intermodal facilities," he says. "We are also getting closer and closer to population centers," says Kianca.
?
In this new scenario, says Kianca, port cities like Jacksonville are favored along with markets like Kansas City, which has the advantage of intermodal facilities. Although Jacksonville is not as large as Kansas City, it does have direct access to the port, and ships can get into Jacksonville fairly easily, he says.
?
"Everyone who is buying logistics properties has a presence in the Southeast," says Kianca, and Chambers Street is no different. It has a significant presence in North and South Carolina markets that are close to Charleston and Savannah.
?
One reason that industrial property owners want to be in the Southeast, says Kianca, is to take advantage of the expansion of the Panama Canal, scheduled for completion in 2015.? The Panama Canal project will make it easier for Asian suppliers to ship goods directly to the East Coast. But in order to accommodate the larger ships that will be coming through the canal, ports need to make infrastructure improvements.
?
"Charleston and Miami are out in front of (with respect to infrastructure improvements)," says Kianca, "and (industrial properties in Miami) are being considered (for acquisition by Chambers Street), but in Charleston and Savannah, you can connect with a greater population.
?
Meanwhile, Kianca says that Chambers Street isn't confining itself to acquisitions in industrial markets in the Southeast. "We are looking throughout the US, wherever we can get the best deals, as well as in Europe," he says.

Liquidate Fannie & Freddie: Sheila Bair's Rx for the Financial ...

Follow The Daily Ticker on Facebook!

In her new book, Bull by the Horns, former FDIC Chair Sheila Bair gives a detailed account of the 2008 financial crisis and its aftermath. As you've probably heard by now, Bair is unfettered in her criticism of Tim Geithner, calling him the "bail-outer in chief" and suggesting the Treasury Secretary was more worried about protecting Citigroup (C) vs. protecting taxpayers.

But the book is more that just a Geithner-slam, even if that's been the bulk of coverage so far. Bair offering a series of recommendations for how to reform and strengthen the financial system, including abolishing Fannie Mae and Freddie Mac.

"The hybrid nature of Fannie and Freddie led to disastrous consequences," Bair writes. "Ultimately, both institutions need to be liquidated."

Given the role Fannie and Freddie play in the housing market ? bigger today vs. before the 2008 crisis -- that's easier said vs. done, as we discuss in the accompanying video.

"There's no agreement on what to do with the GSEs," Bair says. "It's a broader problem with housing policy generally, there's no consensus."

Bair's recommendation for getting rid of Fannie and Freddie is to "do it gradually," and start by forcing the GSEs to charge the banks higher fees for taking the interest rate and credit risk of 30-year mortgages off their books.

"At some point, the market will find it more economically efficient to fund mortgages themselves than pay higher guarantee fees to the government," she says. "That's the simplest way to do it."

While critical of the GSEs, Bair rejects the notion they were somehow primarily responsible for the housing boom and resulting crisis.

There was a "symbiotic relationship" between Wall Street and the GSEs, which were big buyers of mortgage-backed securities, she says. "But this idea we forced Wall Street executives and traders to make all this money because we wanted poor people to have mortgages?that's laughable analysis."

As for why Fannie and Freddie weren't addressed by the Dodd-Frank legislation, Bair's view is reforming the GSEs was "too much to bite off at same time" policymakers were trying to address re-regulating the financial system.

And of course, the "symbiotic relationship" she describes is a big reason why Fannie and Freddie were put into conservatorship in 2008 rather than forced into liquidation. Given Wall Street firms ? not to mention sovereign wealth funds ? were big holders of Fannie Mae's and Freddie Mac's debt, almost everyone had a vested interest in keeping the GSEs intact, or at least not forcing creditors to take a haircut.

Abolishing the GSEs is just one of Bair's recommendations to reform the financial system. As discussed in the accompanying video and part 2 of this interview, others include:

  • Breaking up the Mega-banks.
  • Raise capital requirements for banks.
  • Abolish the OCC and merge the SEC and CFTC.
  • End the 'revolving door' between Wall Street and Washington.
  • Change the tax code to put equity financing on par with debt financing, and earned income on par with investment income.

Study points to potential for improvement in the care, quality of life of epilepsy patients

ScienceDaily (Sep. 28, 2012) ? Routine screening for psychiatric, cognitive and social problems could enhance the quality of care and quality of life for children and adults with epilepsy, according to a study by UC Irvine neurologist Dr. Jack Lin and colleagues at the University of Wisconsin-Madison and Amedeo Avogadro University in Italy.

Physicians who treat those with epilepsy often focus on seizures, Lin said. However, patients show an increased prevalence of psychiatric issues (mood, anxiety or attention-deficit/hyperactivity disorders), cognitive disorders (in memory, language or problem solving) and social difficulties (involving employment or personal interactions). The relationship between epilepsy and these complications is complex and poorly understood. Lin said they may present greater problems for a patient if left untreated.

"Screening for psychiatric, cognitive and social comorbidities is essential not only in established cases but also with newly diagnosed epilepsy," Lin said. "By doing so, we can ensure that these issues are treated and that patients have a better quality of life."

He emphasized that screening should also be conducted prior to any new drug treatment.

Problems that occur in conjunction with childhood and adult epilepsy are referred to by doctors as comorbidities, meaning that they have a greater than coincidental chance of appearing alongside each other though there is not necessarily a causal relationship between them.

The study suggests a number of possible factors responsible for these comorbidities, including the characteristics of epilepsy and its medication protocol, underlying brain disorders, and epilepsy-related disruptions of normal neurodevelopment and aging.

While experts have begun to recognize the effects of psychiatric, cognitive and social comorbidities in epilepsy, Lin noted, gaps remain in the early detection, treatment and prevention of these issues.

Decision making and negotiation part 2: M&As & fund-raising ...

Posted 27th September 2012 in Articles | Register to comment

Jean?Louis Roux Dit Buisson

Foro Ventures

In part two, Jean-Louis Roux Dit Buisson explores the decision-making and negotiations involved in M&As and fund-raising.

(Continued from ?Decision making and negotiation part one: technology licensing?)

Today we are faced with the price to be paid for an acquisition. Literature reports that about 70% of all M&As projects do not perform as expected1 and a recent study performed on IPOs in the Swiss biotech industry reports that 90% of them lose the money after a year2. Additionally, Facebook?s recent fate could be a cruel example of what managers can be induced to when they do not understand the mechanics of valuations, or do not exert their governance duty properly.

profit-loss-statementFigure 1: An example of a company?s profit and loss statement (P&L)

As an example, say you own the company, whose P&L is reported in figure 1, and your Planning and Acquisition VP comes to you with an acquisition project that shows the same profile as yours. Revenues are planned to grow at 3%, and costs to be maintained at their current level over the planning period of 10 years, as approved during the last budgeting round, and subsequent strategic review.

Negotiation dynamics

?Never invest in a business you do not understand.?

Warren Buffet

Bidding time comes around and your Planning and Acquisition VP presents her recommendations to the board. She argues that your company should pay a premium of 30% over the ongoing P/E in order to convince the shareholders to sell, and to buy the approval of the existing management team who fears for its future.

?

?Literature reports that about 70% of all M&As projects do not perform as expected??

?

The board asks how this premium over market estimates can be justified, and the VP answers with the traditional arguments: post acquisition we are going to increase the sales by 5% instead of 3% p.a, then we shall reduce costs by 15%, and we estimate that the terminal value ought to be included in the valuation. All these measures will help raise the company value from ?125 to ? 315, and thus we recommend paying the 30% premium over current P/E.

The board nods positively, except one non-operating director who says:

?Well, why don?t we first try these measures on our own business, as it seems so easy to grow sales 5% instead of 3% (a 66% increase by the way), to reduce costs across the board by 15% [how can sales grow faster with a marketing and sales budget reduced by 15%] and sell the company at 3 times sales down the road, when our current P/E is 7.1, equivalent to 1.1 times sales??

?example-company-negotiation-tableFigure 2: An example of a company?s negotiation table

And then he pulls out a table (such as figure 2) showing the impact of any of these measures on the NPV and EBITDA, asking each time, why can?t we do it on our own business first?

Deciding upon a proper thinking process

When asked by the president of the board what he would suggest, the non-operating director proposes a value creating plan based on sound analysis of Pareto effects on contribution and gross margins, threshold effects on marketing and promotion expenses, and redundant positions in the G&A sector.

value-premium-priceFigure 3: Computed with Excel add-ons, the blue surface is proportional to the probability of being in the money, 0.2 in this case

When these measures are diligently implemented using the proper evaluation tools, the computed value of the targeted company can be increased.

?

?Companies acquired for their development pipelines raise the additional issue of sharing value and risk.?

?

However, in our case the probability of adding value over the premium price paid is less than 0.2. This is highlighted in figure 3, above.

The case of development companies: fund raising

Companies acquired for their development pipelines raise the additional issue of sharing value and risk. It might be in the interest of the targeted company to get a higher share of the expected value of the pipeline, while earning this share as milestones are achieved.

value-shares-tableFigure 4: An example showing development outcomes

The tools and methodologies available to finance directors allow for developing negotiation tables with investors, whereby the dilution linked to additional rounds of financing can be modeled based on hypothesis for development outcomes, as highlighted in the example above in figure 4.

Conclusion

When dealing with value driving issues such as M&As or fund raising, modern evaluation tools, methodologies and approaches bring valuable insights to the boards keen on exerting their governance responsibilities.

Overreliance on common sense hypothesis fed in formulas whose rationale has been forgotten even by the key players, might partly explain the important number of failures in M&A as well as in investment activities.

Finally, always ask yourself if it is so easy to plan for that acquisition target, why is it so difficult for us to implement in our own activities?

Josmar Trujillo: We're Fighting For the Same Thing: Better Schools

I found myself unusually cheerful as I monitored reports coming
out of the Chicago teachers? strike. A powerful show of force in the
streets, I mused, was long overdue on the issue of the American
education system.
A friend of mine, however, pointed out that I recently had fought tooth and nail to keep open a charter school, my son?s former school, while the Chicago strikers see the charter movement as an attack on public education.
Faced with this contradiction, I wondered about the battle lines drawn in so many fights about education today. For example, when charter schools offer choices to families but also are seen as a threat to district schools or when union leaders choose to shut down a school system to fight for its members? rights. In these fights I now see more common ground than people may like to admit, or at least more than I realized.
I felt a connection with the striking Chicago teachers as they fought with City Hall and pointed to two issues that were important to me: class size and an over-emphasis on standardized testing. It reminded me of my battle for education in the Rockaways, where I live, which was not about ideology alone but involved more practical demands.
The bottom line is all of us were fighting for the same thing: high-quality public schools in our neighborhoods.
Earlier this year I wrote to SchoolBook about the fight that I and other
parents of students at Peninsula Preparatory Academy Charter School had waged to stop its closure. Despite protests, petitions and even a meeting with Schools Chancellor Dennis Walcott, the Department of Education would not heed the voices of the parents. The closure was proceeding until Advocates for Justice, a social justice law firm, and school lawyers were able to secure a restraining order to keep the school open, at least for the short term.
During those hectic months last school year, parents scrambled to make contingency plans, the school administration
balanced a legal fight with all the business of running a school, and our children took grueling year-end tests. Some of the consequences of being left in legal limbo (our charter was not renewed but technically we were still open) were that many students and teachers left the uncertainty of PPA. We also lost our lease on a wonderful facility we had secured two years prior.
Also, as we mobilized we felt the stigma that comes with the label of ?charter.? No union-leaning groups or elected officials felt comfortable helping us even as the absurdity of closing one of the Rockaways? strongest-performing schools was apparent. A casual observer might make the mistake of assuming PPA parents were loyal charter advocates. Some may have been, some not. We
were, more accurately, advocates of Peninsula Prep and its amazing principal, Ericka Wala.
I imagined that the Chicago teachers also felt the political stigma that comes with taking sides in a public demonstration.
Peninsula Prep is now open and currently teaching the Rockaways? youngest citizens important values that supersede the general
curriculum. One of these is determination, which we will continue to need. The possibility that the school will be closed mid-year still exists.
My son Jadyn is now enrolled in third grade at a district school because PPA?s new location doesn?t allow me time to get him there and deliver my other son to his pre-kindergarten. But my experience at PPA allowed me a chance to experience education in a unique way and lent me some new perspectives on charters, to which I had previously been hostile. A close partnership with the principal and solidarity with parents, forced in a battle for the school, convinced me to continue to advocate for the school.
At a time when some parents needed a restraining order to have their children taught at their school of choice, I believe we have to set the best example possible for our children and continue to fight for education.
Just like the teachers did in Chicago.

Josmar Trujillo is the former co-president of the Peninsula Preparatory Charter School in Rockaway, Queens.

Russian official snubs meeting of "Russophobic" Europe lawmakers

MOSCOW (Reuters) - A senior Russian official said on Thursday he would skip a meeting of European lawmakers next week because of "Russophobic" attitudes among them, in a fresh sign of tensions between Moscow and Europe.

Russia has rejected European criticism of its human rights record and of the two-year jail sentences handed to members of punk band Pussy Riot last month for a protest against President Vladimir Putin in a church.

Parliament speaker Sergei Naryshkin, a member of the ruling United Russia party, was to have been a key speaker at the October 1-5 session of the Parliamentary Assembly of the Council of Europe (PACE) in Strasbourg, France.

"But as the session's opening was nearing we felt that key strategic proposals of mine would not be heard by a number of leaders of the Parliamentary Assembly and a number of Russophobic delegations," Naryshkin said in televised remarks.

"I came to the conclusion that it will be possible for me to address a PACE session (only) when the conditions are suitable," said the chairman of the State Duma lower house.

Critics of United Russia, formerly headed by Putin and now by Prime Minister Dmitry Medvedev, say it is helping orchestrate a Kremlin clampdown on dissent by hastily passing restrictive legislation, such as laws tightening controls of Internet and foreign-funded NGOs and increasing fines for protesters.

State-run RIA news agency reported that the rest of the Russian delegation would take part in the PACE session, which is due to discuss Russia's adherence to its obligations as a Council of Europe member, including over human rights, pluralist democracy and the rule of law.

Russia has made some "very positive steps", but some measures introduced raise serious concerns, PACE said in a document posted on its website.

The European Union's foreign policy chief Catherine Ashton said this month that Russian authorities had been "chipping away" at fundamental rights and freedoms since Putin's return to the presidency in May.

Drew HEALTH Promotes Family Health and Fitness | Monticello Live

September is Family Health and Fitness month. What form of exercise doesn?t take any instruction, can be done almost anywhere or anytime, costs nothing and has the lowest rate of injury for any exercise? Give up?

Walking is the answer to all these questions and more. By walking at a steady pace, by increasing your distance each time you walk, and by walking more often, your health could greatly improve.

But there are still more questions! When should we walk? What time of day should we exercise? When should we stop? Below are some tips to help get the most out of walking:

? Choose a comfortable time of day to exercise, not too soon after eating and when the air temperature is not too high.

? Be careful not to overexert. Stop if you find yourself panting or feeling nauseous, if your breathing doesn?t return to normal within ten minutes after exercising, or your sleep is affected.

? Don?t over do it! Spend adequate time warming up, and building up. Don?t increase the number of miles you walk to quickly.

? Wear shoes that are comfortable and provide good support. Shoes should provide arch support and shouldn?t cause blisters or calluses.

? Wear lighter clothing than normal because brisk walking generates a lot of body heat. In colder weather, wear several layers of light clothing. They will trap body heat and are easy to shed if you get too warm.

? Some people like to exercise with others. If that?s the case, pick a buddy and get in better shape together!

? Always remember that it?s a good idea to discuss it with your doctor before starting any type of new exercise routine.

The Drew HEALTH Coalition meets monthly to develop and implement plans to create healthier communities. If you are interested in addressing family health, or other health issues, we invited you to attend our monthly meetings. For more information contact Karen Brown at 870-367-6234.

Supreme Court upholds West Virginia redistricting

WASHINGTON (Reuters) - The Supreme Court upheld West Virginia's congressional restricting map as constitutional on Tuesday, overturning a lower court order that found the plan violated the principle of "one person, one vote."

In an unsigned opinion, the court said that a federal district court panel had erred in voiding the map in January and had failed to give appropriate deference to the Democratic-controlled legislature that had crafted it.

West Virginia had argued that it had legitimate interests in allowing small variations in populations served by each district such as making districts compact, not splitting counties between districts, and avoiding contests between incumbents.

The drawing of congressional districts often generates litigation because of its potential to reduce political power of various constituents, including political parties and individual municipalities or counties.

The Jefferson County Commission claimed that West Virginia's plan appeared to dilute the voting power in the state's faster-growing Eastern Panhandle by splitting that region up.

The state's plan also had a population variance between the largest and smallest districts of 0.79 percent of the population of the average district, in line with plans that the Supreme Court had upheld in the past.

But the Supreme Court said it was not essential that a state draw districts with "precise mathematical equality" so long as small variations serve legitimate objectives.

It said such deviations were justified in this case, in light of the state's interests and the absence of better alternatives that offered greater population equality.

The court noted that one alternative, branded by supporters as the "Perfect Plan," would have achieved virtual population equality - a population difference of one person between the largest and smallest districts - at a cost of splitting counties, pitting two incumbents against each other, and moving one-third of the state's population into a new district.

West Virginia has three congressional representatives.

"We're incredibly disappointed," Stephen Skinner, a lawyer for the Jefferson County Commission, said in a telephone interview. "The law until today has been crystal clear, and the Supreme Court has changed the standards. To place arbitrary county lines over mathematical certainty does not comport with truly representative government."

The Supreme Court had put the lower court order on hold while it reviewed the matter. It returned the case to the district court for further proceedings.

The case, brought in the name of West Virginia's secretary of state, is Tennant et al v. Jefferson County Commission, U.S. Supreme Court, No. 11-1184.

Health Care Providers Turn to Therapeutic Video Games

tex playing video games

tex playing video games (Photo credit: Wikipedia)

It seems like someone in the media is always making noise about how video games are negatively impacting the younger generation, instilling in them a sense of violence, irresponsibility, and laziness. Not only do television shows and movies depict die-hard gamers that will skip showering, eating, and sleeping in order to get the high score, to the point that they must be hospitalized, but these extreme events actually happen in real life on occasion. It seems like teen gamers make the headlines a couple of times a year when they?re found dead after 2-day marathon gaming sessions in which they fail to eat, drink, or sleep. It may sound like an urban legend, but it happens. However, it?s difficult to blame video games for these isolated incidents. In truth, the influence of video games depends not only on the game, but also on the person playing it. Most people see video games as the tools for recreation that they are, rather than a serious endeavor with real-world consequences. But could video games do more? Could they influence our health and well-being? And could they do so in a positive way?

According to a new study published in the Science Translation Medical journal by Dr. Carol Bruggers (of Children?s Medical Center) and colleagues from a variety of disciplines, video games could have a therapeutic effect on patients with chronic diseases. But these aren?t just any video games. It?s not as though playing the latest version of Diablo or Madden will help the average patient deal with diseases and disorders like asthma, autism, cancer, diabetes, or Parkinson?s, just for example. But games that empower patients to take control of their own health and fitness by setting attainable goals may have an additional therapeutic effect that helps them to overcome or at least deal with their ailments. That was the theory posited by the team, and the evidence they gathered seems to support it.

The study focused specifically on health-related games (or exergames), some of which were sedentary in nature while others prompted players to get up and move. They also created their own game, the Patient Empowerment (or PE) Exercise Video Game, designed to help patients get in touch with their ?fighting spirit? even as they addressed health issues relevant to their particular disease or disorder. It turns out that playing video games has the potential to raise levels of dopamine in the brain. The hope is that this could be a non-pharmacological method of dealing with the physical, mental, and emotional trauma caused by certain diseases, although this outcome is as yet unknown. However, health care providers are interested in video games as a course of treatment for several reasons.

First of all, video games are fun and engaging. People approach them with this attitude. So while patients might not be too keen to get on a treadmill in order to improve health, they may certainly be willing to play a video game that allows them to choose their own activities and virtually take control of their health. Plus, these games can blend physical therapy with motivational tactics that will help patients to reach a variety of goals, such as weight loss or increased strength, endurance, and stamina, for example. And of course, the combination of fun and exercise can make people feel good physically, mentally, and emotionally. It?s a little different than the boost one might get from earning WOW gold in-game, but for patients facing serious medical concerns, the potential benefits of therapeutic exergames could provide a much more powerful incentive to play.

Kid Koala bundles working cardboard gramophone with new album, spurs on budding turntablists video

If you've been enough of a Kid Koala fan to have heard his original Scratchcratchratchatch mixtape, you'll remember a sample that mentioned building a "finger-powered record player." Kid Koala, also known as Eric San, certainly remembers -- buy the Limited Edition of his recently launched 12 Bit Blues album and you'll get your own functional, build-it-yourself cardboard gramophone along with a playable disc. The only further requirements are a sewing pin and some hand power. It's cheaper than tracking down the real thing, and a nod both to San's turntablist style as well as the back-to-basics nature of the music. We call it clever and potentially inspiring; just remember that you'll want some proper equipment before you DJ any house parties.

Clear Communications: Calming the Crisis Sea | Howell Marketing ...

September 24th, 2012?????? no comments???

I am writing this from the 5th floor of a condo in Seacrest, Florida overlooking the beautiful Gulf of Mexico, the ?Emerald Coast? as the beaches of South Walton are called. I?m here with my team teaching crisis communication and discussing organizing an event here next year for those in PR who want to learn more. We found some shells on the beach yesterday and I?m always drawn to the broken and tumbled shells?worn out but still beautiful. I feel that way sometimes, especially when getting through a crisis. We are reading PR News? Crisis Management Guidebook, Volume 5 and let me tell you, it?s worth the price I paid to get it. Excellent material here and advice/examples that you can use. One of my favorite chapters in the book highlights the importance of the voice of the leader in a crisis?so true and so important.

The excerpt written by Assaf Kedem (formerly?VP/Director, Senior Writer and Editor of Alternative Investments at AllianceBernstein) has this quote: ?Companies that neglect employee communication practices in good times stand a greater chance of failing to achieve their communication objective when things turn sour.? Very true. In my experience working with clients through crisis, the voice from the top must be clear, concise and constant. Statistics show that a crisis will happen to most organizations at some point?often by surprise. I tell my clients that often it?s not WHAT happens to you but HOW you HANDLE the WHAT that happens. Here are seven steps in Kedem?s narrative that help create a culture of communication in times of stress:

1. The message must come from the TOP

2. Don?t paper over it: don?t spin bad news, but tell it like it is

3. Communicate your leadership, muster employee support and set the example

4. Supplement written communications with verbal ones. This is very true and here?s a quote that I love: ?In challenging times, there can be no substitute for voice. Verbal communication?especially if it?s face-to-face?is more personal. Speech offers such audible and visual catalysts as cadence, diction, body language and intonation that can help convey thoughts, sentiments and emotions more fully and effectively??

5. Keep the communication going, even if it?s regurgitating

6. Consider additional channels (hotlines, social media, etc.)

7. Don?t forget recognition: recognize employees who are contributing and carrying the company banner of support

It is difficult to prepare for a crisis but important to try. We are going to be updating client crisis plans as having that discussion and planning session at least helps. The closest thing to having a full plan is having a culture of good communications. This culture can weather a storm much better than that of poor communications. How well would your company do in the rough sea of a crisis?

Weekly Webcomic Wrapup is waiting in line | Joystiq

This week, Apple released the iPhone 5. It's become a sort of cultural expectation that people will wait in line for hours to buy a new Apple device on launch day. Game consoles have shared in the phenomenon, as Nintendo's Wii system couldn't stay on retail shelves for years.

Wii U pre-orders rocked online retailers as well this week, to the point that GameStop started up a wait list for those looking to buy the system. Is this a matter of high demand or low production on Nintendo's behalf? That's hard to answer without reliable sales figures. Could Nintendo take after Apple with its upcoming home console, seeing people line up for hours this holiday season to scoop up the Wii U? All signs point to "yes" on that one.

For me, I fear that if I don't get a Wii U this holiday season due to my personal disinterest in the launch lineup, there's a looming possibility that this is my only reasonable shot at owning the system until the 2013 holiday season. For once, I feel I can empathize with Apple devotees that feel as though they can't wait another day for the next iPhone. So while you're waiting in line today, whether it's to pick up your new iPhone 5 or to buy your groceries, check out last week's webcomics and vote for your favorite after the break!
